These terms govern public website access, the Training Academy, Demo Showroom and publicly available materials.
Terms of Use
Clear rules for using our websites, learning resources, demos and public Presto PDCA content.
These Terms of Use explain the conditions that apply when you visit websites operated by TOPP Tactical Intelligence Limited, browse Presto PDCA public content, use the Training Academy or Demo Showroom, download public resources or access other website features made available by us.
You may use permitted resources for genuine internal learning and business purposes, but not resell or exploit them commercially without permission.
Keep account credentials secure, respect access controls and do not attempt unauthorised access, interference or security testing.
Subscriptions, implementation, support and customer data may be subject to separate commercial and data-processing terms.
Scope and acceptance
These Terms of Use apply to websites operated by or on behalf of TOPP Tactical Intelligence Limited ("TOPP TI", "we", "us" or "our"), including public Presto PDCA pages, the Training Academy, Demo Showroom and other public online resources.
By accessing or using these websites or resources, you agree to these Terms of Use and acknowledge that our Privacy Policy and Cookie Policy may also apply. If you do not agree with these terms, you should not use the relevant website or resource.
You are responsible for ensuring that anyone who accesses our websites through your internet connection or under credentials for which you are responsible is aware of these terms and complies with them.
Definitions and interpretation
- "You" and "your" mean the person accessing the website and, where relevant, the organisation on whose behalf that person is acting.
- "TOPP TI", "we", "us" and "our" mean TOPP Tactical Intelligence Limited.
- "Website" means this website and any other website operated by or on behalf of us.
- "Presto PDCA" means our software platform, related products, learning environments, demos, documentation and associated services.
- "Content" means text, images, graphics, videos, software demonstrations, code, downloads, job aids, publications, reports, models, templates and other material made available through our websites.
Headings are provided for convenience and do not affect interpretation. References to legislation include amendments, replacements and subordinate legislation where applicable.
Website terms versus customer agreements
These Terms of Use primarily govern public website and learning-resource access. They are not intended to replace a signed customer contract, order form, subscription agreement, statement of work, data-processing agreement, support agreement or other commercial terms agreed between TOPP TI and a customer.
Your organisation's applicable commercial agreement governs the paid service, subscription, customer data, implementation commitments, service levels, confidentiality and other contracted obligations. If there is a direct conflict between that agreement and these website terms in relation to the paid service, the signed agreement will take priority to the extent of that conflict.
Intellectual property rights
The Website and Content include materials protected by copyright, trademark, database rights and other intellectual-property rights owned by TOPP TI, its licensors, partners or other rights holders.
Unless these terms or the relevant material expressly say otherwise, you may not copy, modify, adapt, reproduce, republish, distribute, sell, sublicense, create derivative works from, reverse engineer, scrape, systematically extract, frame or commercially exploit the Website, Presto PDCA, software demonstrations, designs, documentation or Content without prior written permission from the relevant rights holder.
Product names, logos, brands and marks displayed on our websites may be trademarks or trade names of TOPP TI, its partners, customers or third parties. No licence to use a trademark is granted merely because it appears on the Website.
Where we make a publication, job aid, demo, template or other resource available for use or download, you may use it for genuine internal learning and business purposes within your organisation unless a different licence or notice accompanies that resource. Resale, external commercial exploitation or removal of ownership notices is not permitted without written consent.
Permitted use
Subject to these Terms of Use, we permit you to browse our public websites and to view, print or store reasonable extracts of public Content for your personal use or legitimate internal business use.
You may use public press releases and material clearly identified as public for external communications provided the material is used accurately, the source is identified and the use does not imply endorsement, partnership or approval where none exists.
Demonstrations, models, training examples and public learning materials may be used to evaluate or learn about Presto PDCA, but no rights in the underlying software, platform architecture or proprietary methodology are transferred to you.
Acceptable use
You must use the Website lawfully and in a manner that does not harm our systems, users, customers, reputation, intellectual property or legitimate business interests.
Information you provide through registration, forms, demos or privileged areas should be accurate and not misleading.
Use only accounts, areas, resources and permissions you are authorised to access.
Do not attempt to gain unauthorised access, bypass security, probe systems, introduce malicious code or interfere with website operation.
Do not upload, transmit or publish material that is unlawful, defamatory, infringing, deceptive, threatening, malicious or otherwise harmful.
Do not use bots, scraping, crawling or automated tools to extract substantial Content or interfere with normal service operation unless we have expressly authorised it.
Do not resell, rebrand, commercially distribute or use our protected materials to create a competing product or service without written permission.
You must comply with applicable law when using our Website. This includes laws relating to computer misuse, intellectual property, privacy, confidentiality, defamation, fraud and communications.
Accounts and privileged areas
Parts of our websites, Demo Showroom or learning environments may require registration, a session, a unique link, customer access, credentials or another form of authorised access.
You agree to:
- provide accurate information when registering or requesting access;
- keep passwords, access links and other authentication information confidential;
- not share credentials except where expressly permitted;
- notify us promptly if you reasonably suspect unauthorised access or compromise;
- use privileged areas only for the purpose and organisation for which access was granted; and
- accept responsibility for activity carried out through your credentials to the extent permitted by law and applicable contract.
We may require password changes, additional authentication or other security steps where reasonably necessary to protect the Website, users or customer environments.
Demo Showroom, Training Academy and learning content
The Presto PDCA Demo Showroom, Training Academy, screenshots, sample records, demonstrations, case-study material and training examples are intended to explain concepts, features and possible ways of using the platform.
Demo environments may contain sample, anonymised, synthetic, historical or illustrative information. You should not assume that example data represents a current customer, live operating environment, guaranteed product configuration or commitment to deliver a particular future feature.
Operational-excellence, management, strategy, KPI, project, governance and process guidance is provided for educational and informational purposes. Your organisation remains responsible for its own decisions, controls, compliance obligations and implementation choices.
AI-assisted and automated features
Public demonstrations or Presto PDCA features may include optional AI-assisted functionality that helps structure, summarise, classify, suggest or generate business content.
AI-generated or automated output may be incomplete, inaccurate or unsuitable for a particular business situation. You remain responsible for reviewing output, applying appropriate professional judgement and deciding whether to use, modify or reject it.
You should not submit confidential, sensitive, restricted or regulated information to an AI-assisted feature unless your organisation has authorised that use and the relevant feature, contract and privacy information permit it.
Material you submit
You remain responsible for information and material you provide through our website, contact forms, feedback channels, public forms or other submission mechanisms. You should only provide material you have the right to provide and that does not infringe another person's rights or breach any legal, contractual or confidentiality obligation.
Unless a specific submission mechanism, confidentiality agreement or customer contract says otherwise, unsolicited suggestions, product ideas and general feedback may be used by TOPP TI to evaluate, improve and develop our products and services without an obligation to compensate you for doing so.
Information submitted by a customer or authorised user into a contracted Presto PDCA environment is not treated as an unsolicited public submission. Customer data is governed by the applicable customer agreement, privacy terms and data-processing arrangements.
We do not ask you to transfer ownership of material merely because you send us a support request, contact enquiry or other ordinary business communication.
External links and third-party services
Our websites may contain links to third-party websites, platforms, documents, videos, booking services, payment services or other external resources.
Third-party services are generally operated independently from TOPP TI. A link does not necessarily mean that we endorse, control or accept responsibility for the third party, its content, availability, privacy practices or terms.
If you leave our Website or choose to use a third-party service, you should review the terms, privacy notice and other conditions that apply to that service.
Website availability and changes
We aim to keep our public websites and resources useful and available, but we do not guarantee uninterrupted access. We may change, update, suspend, remove or withdraw pages, resources, features, demonstrations or website access where reasonably necessary.
Content may become outdated as Presto PDCA evolves. Training pages and feature descriptions should therefore be read in the context of the product version, release information and customer configuration relevant to you.
Disclaimers and no warranties
To the extent permitted by law, public website Content is provided for general information, learning and evaluation purposes and is made available on an "as is" and "as available" basis.
We do not warrant that public website Content will always be complete, accurate, current, error-free or suitable for your particular purpose, nor that access to public websites will be uninterrupted, secure or free from all defects.
Nothing on the public Website constitutes legal, tax, accounting, financial, medical or other regulated professional advice. Operational, management and business guidance should be assessed in the context of your own organisation and professional obligations.
Specific warranties, service commitments or remedies for contracted Presto PDCA services are governed by the applicable customer agreement rather than this section.
Limitation of liability
Nothing in these Terms of Use excludes or restricts liability where it would be unlawful to do so. In particular, nothing is intended to exclude or restrict liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot lawfully be excluded.
Subject to the paragraph above, and to the fullest extent permitted by applicable law, TOPP TI will not be liable for indirect or consequential loss arising solely from use of or inability to use our public Website or public Content, or from reliance on public informational or training material.
Where a business user accesses public website material, TOPP TI will not be responsible, to the extent permitted by law, for loss of profit, revenue, business, contracts, anticipated savings, goodwill or business opportunity arising from reliance on the public Website.
Liability relating to a paid Presto PDCA subscription, implementation, contracted support service or other commercial engagement is governed by the applicable customer agreement, including any agreed liability limits and exclusions.
Responsibility for misuse
You are responsible for your own unlawful or unauthorised use of the Website and for material you submit. Where permitted by law and where reasonably connected to your breach of these Terms of Use, you may be responsible for losses, claims or costs caused by that breach.
Nothing in this section is intended to impose liability where doing so would be unlawful, unreasonable or inconsistent with a separate contract that governs the relevant activity.
Privacy, cookies and personal information
Our Privacy Policy explains how TOPP TI handles personal information, including information provided through website forms, accounts, demonstrations and services. Our Cookie Policy and any cookie-preference controls explain how cookies and similar technologies are used.
By using our Website, you acknowledge that these separate privacy and cookie notices may apply in addition to these Terms of Use.
You can review our current privacy information at Privacy Policy.
Suspension and termination of access
We may suspend, limit or terminate access to privileged website areas, demo environments or public resources where we reasonably believe it is necessary for security, maintenance, legal compliance, protection of intellectual property, prevention of misuse or enforcement of these Terms of Use.
Where access is governed by a customer agreement, suspension and termination rights relating to the contracted service will be governed by that agreement.
Governing law and jurisdiction
These Terms of Use and any non-contractual obligations arising out of or in connection with them are governed by the laws of England and Wales, except where mandatory law requires otherwise.
If you are using the Website for business purposes, the courts of England and Wales will have exclusive jurisdiction over disputes arising out of or in connection with these Terms of Use, subject to any different jurisdiction agreed in a separate customer contract.
If mandatory consumer law applies to you, nothing in these Terms of Use is intended to remove rights or jurisdiction protections that cannot lawfully be excluded.
Changes to these Terms of Use
We may revise these Terms of Use from time to time to reflect changes in the Website, Presto PDCA, our business practices or applicable law.
The "Last updated" date at the top of this page shows when this version was revised. Changes apply from the date the updated terms are published unless a later date is stated.
If you continue to use the Website after updated terms take effect, your continued use will be subject to the revised Terms of Use.
